Welcome to Cycla. These Terms & Conditions ("Terms") govern your access to and use of the Cycla mobile application ("App") and related services (collectively, the "Services"), operated by Cycla ("we", "us", or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

You must be at least 16 years old to use Cycla. By creating an account, you confirm that you meet this age requirement. If we learn that a user is under 16, we will promptly delete their account and all associated data.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct we deem harmful to other users or the Services.

The Services are designed for general fitness and wellness purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

By using the Services, you assume full responsibility for your health and safety. You agree to use the App in conjunction with, not in place of, professional medical guidance.
Cycla offers both free and premium subscription tiers:
Premium subscriptions include a 14-day free trial for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
All subscriptions are processed through Apple's In-App Purchase system and are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You will be charged through your Apple ID account.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. We do not offer pro-rated refunds for partial subscription periods.
All purchases are processed through Apple's payment system. Refund requests must be submitted directly to Apple in accordance with their refund policy. We do not control Apple's refund decisions.
We reserve the right to modify subscription pricing at any time. Price changes will not affect your current subscription period but will apply upon renewal. We will provide at least 30 days' notice of any price increase.
You retain ownership of all data you enter into the App, including cycle data, symptoms, workout logs, and other health information ("Your Content"). By using the Services, you grant us a limited licence to process Your Content solely for the purpose of providing and improving the Services.

All intellectual property rights in the Services, including but not limited to the App, software, design, text, graphics, logos, algorithms, and trade marks, are owned by or licensed to Cycla. You may not copy, modify, distribute, sell, or lease any part of the Services without our express written permission.
The Cycla name, logo, and all related branding are trade marks of Cycla. You may not use these marks without our prior written consent.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Services, you consent to the practices described in the Privacy Policy.
Cycla processes special-category personal data under GDPR Article 9, including menstrual cycle data, symptoms, and health conditions (such as PCOS, endometriosis, and perimenopause). We process this data based on your explicit consent (Article 9(2)(a)).

Your data is stored on Supabase infrastructure in the EU. We use industry-standard encryption (TLS in transit, AES-256 at rest) and row-level security policies to protect your information. However, no system is completely secure. You use the Services at your own risk.
We use Sentry for error tracking to improve app stability. Health data is scrubbed from error reports before transmission. For more details, see our Privacy Policy.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not warrant that:
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Cycla and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.

In no event shall our total liability to you for all damages exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

These Terms are governed by and construed in accordance with the laws of France and the European Union, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of France.
Before initiating formal legal proceedings, we encourage you to contact us at hello@getcycla.app to attempt to resolve the dispute informally.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cycla regarding the Services and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
The Services may integrate with third-party services (such as Apple Health, payment processors). Your use of those services is governed by their respective terms and conditions. We are not responsible for third-party services.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, or internet outages.
